Organic Labeling Regulations in the United States: What Brand Owners Need to Know
Many practitioners launching their own supplement brand want to highlight clean, high-quality ingredients. One of the most restricted claims in the U.S. is the word “organic.”
As of March 2024, the Strengthening Organic Enforcement (SOE) final rule significantly tightened the rules around who can use organic claims and how. Understanding these regulations helps you protect your brand and stay fully compliant.
Key Changes Under the Strengthening Organic Enforcement (SOE) Rule
The SOE final rule (fully implemented March 19, 2024) expanded certification requirements across the entire organic supply chain.
Under the updated rules, almost all businesses that handle organic products must be certified, including:
- Brand holders / brand owners
- Resellers
- Manufacturers
- Importers
- Brokers and traders
There are only very limited exemptions (for example, certain small operations with under $5,000 in annual organic sales or specific retail situations).

Why Origin Well Nutrition Recommends Against “Organic” Claims

Because of the SOE requirements:
- Simply using organic-certified raw ingredients is not enough.
- The brand owner (you) would need to obtain and maintain your own USDA Organic certification for the finished product if you want to use “organic,” “USDA Organic,” or similar claims.
- Using these claims without proper certification can lead to enforcement actions, civil penalties, product recalls, or other regulatory consequences.
For this reason, Origin Well Nutrition strongly recommends that brand owners do not use any “organic,” “USDA organic,” or similar claims on:
- Product labels
- Websites and online stores
- Social media
- Marketing materials
- Any other promotional content
This recommendation protects both your brand and your professional reputation.
